Regulation in a nutshell

Regulation: Packaging and Packaging Waste Regulation (EU) 2025/40 ("PPWR"). In force since 11 February 2025, applicable since 12 August 2026.
Who it affects: Producers and sellers who supply packaged goods to end users in Poland through distance contracts, including online marketplaces, and who have no establishment in Poland.
What is required: Appointing an Authorized Representative established in Poland. The AR registers you, reports the quantities of packaging you place on the Polish market, and manages the related compliance obligations, including EPR fees.
If you do not: You have no legal right to sell to Polish consumers, and marketplaces are expected to require proof of registration and may block listings that lack it.
Worth knowing: The European Commission has proposed suspending this specific obligation until 2035 for producers already established elsewhere in the EU. That proposal is not yet adopted. Companies established outside the EU are not covered by the proposed suspension regardless of the outcome.

What is an Authorized Representative under PPWR?

A locally established entity that takes on registration, reporting and financing duties on behalf of a foreign producer, so the producer can legally sell into that country.

Do I need one if my company is already based in the EU?

As things stand, plan as if yes. The Commission has proposed suspending this specific requirement for EU-established producers until 2035, but that proposal has not been adopted. We will tell you where things stand when we get back to you.

What happens if I do not appoint one?

You lose the legal right to sell to Polish consumers, and marketplaces are expected to enforce this by blocking unregistered listings.
